ACCEPTANCE OF POLICIES AND REGISTRATION CONDITIONS
Thank you for registering for this corporate event (the “Event”). Regardless of whether your registration is submitted by you or your proxy, the following Corporate Event Terms and Conditions (these “Terms”) apply to you and your participation at the Event. Depending on the type of event (whether in-person or virtual), certain terms herein may not apply. “Attendee(s),” for purposes of these Terms, means all registered ticketholders at the Event, including, without limitation, any individual engaged by any registered ticketholder to provide media services for the benefit of such ticketholder at the Event, and excludes speakers, sponsors, and vendors (collectively, “Vendors”). By registering for, or by attending, this Event, you agree to be bound by these Terms, so please read them carefully. Should you not wish to accept these Terms, you should not register for or attend this Event. Submission of your registration information is regarded as affirmation of your acceptance of these Terms. These Terms include and incorporate by reference the eXp World Holdings, Inc. Privacy and Data Processing Policy (https://expworldholdings.com/privacy-policy/). If there is any conflict between these Terms and the eXp World Holdings, Inc. Privacy and Data Processing Policy, these Terms will prevail. This Event is organized by eXp World Holdings, Inc., and its affiliates and subsidiaries (“eXp”). eXp reserves the right, in its sole and absolute discretion, to limit or deny access to any entity or individual for any time and for any reason, without refund.
EVENT REGISTRATION
-
- Ticket Refund Policy. Refunds for Event ticket purchases will be issued only if a refund request is made through the hyperlink provided on your electronic ticket confirmation receipt by not later than sixty (60) days prior to the start of the Event (the “Refund Deadline”). Refund requests received after the Refund Deadline will not be honored. Refunds will not be issued for nonattendance at the Event.
- Partial Payment Policy. You may select to pay the Event ticket partially upon registration. By selecting the “Partial Payment” option on the payment page, you agree to pay the minimum amount indicated therein. Your remaining balance must be fully paid at least seven (7) days before the Refund Deadline (the “Payment Deadline”). If your remaining balance is not fully paid by Payment Deadline, you hereby authorize eXp to charge your credit card on file for the remaining balance any time after the Payment Deadline. To pay the remaining balance of your Event ticket, you may click the “View or Modify Registration” hyperlink provided at the bottom of your electronic ticket confirmation receipt. You will be taken to the registration page and prompted to enter your confirmation number that is reflected in your electronic ticket confirmation receipt. After clicking “Submit”, you will be taken to your “Registration Summary” section. Click the button of “Submit Payment” to pay another installment, or the remaining balance of your Event ticket. Please note that you will not be able to transfer your Event ticket or attend this Event without your Event ticket being paid-in-full.
- Taxes. Any payment amounts made by you shall be exclusive of any applicable sales or use taxes, or any other taxes or fees assessed on, or in connection with the Event ticket purchase. eXp shall use its best efforts to establish the applicability of indirect taxes to any Event ticket payment amounts and will charge indirect tax on invoices where eXp reasonably believes, or is advised by the relevant tax authorities or its tax advisors that it is legally obliged to do so. If any amount payable by you hereunder is subject to any withholding or other, similar tax under applicable laws, you shall provide eXp on a timely basis, with copies of official tax receipts or other evidence of payment of such withholding taxes sufficient to permit eXp to support a claim for a credit for such taxes. To the extent that any withholding tax is payable under applicable laws, you shall provide eXp with all assistance reasonably requested by eXp to obtain the benefits of any applicable tax treaty.
- Registered Ticketholder Substitution and Badge Policy. You must obtain an Event badge in order to be admitted to Event. Event badges are issued to, and can be picked up and used only by, the Attendee named in the registration. Admittance to Event may be denied if your name, as reflected on an Event Attendee badge, does not match your name as registered with eXp. Sharing of Event attendee badges is not permitted. Photo identification will be required for each Attendee when picking up a badge onsite. Badges must be worn at all times during the Event. Each Event ticket is transferrable. Transfers may be made at any time up to the day immediately preceding the start date of Event. Transfers may only be made through the hyperlink provided on your electronic ticket confirmation receipt and will require the entry of the transferee’s name and contact information into eXp’s registry. eXp does not preclude the resale of your Event ticket to another person, provided that the resale price for each Event ticket being sold is not greater than the original purchase price for such Event ticket (“scalping” Event tickets is not permitted). In doing so, you must adhere to the transfer terms described in the preceding paragraph. Failure to update the new ticketholder’s name in eXp’s registry may preclude that person from obtaining an Event badge issued in their name. Consequently, they may be denied admission to Event. If you sell your ticket, you take all responsibility for exchanging funds and ensuring that the new ticketholder’s name and contact information is timely and correctly entered into eXp’s registry. Invitations that are part of an invitational program are non-transferable and are not eligible for resale. An Event badge allows an Attendee entry to the overall Event, but does not guarantee admission to every session, lounge, or meeting area. Admission is subject to venue capacity and other requirements. Certain sessions may be restricted by duly authorized vendors.
- Currency Policy. All payments and refunds are processed in the same currency as the currency used by eXp for the sale of Event tickets (the “Ticket Currency”). For example, if eXp sells Event tickets for “eXpcon International” in euros, then the Ticket Currency shall be in euros. Payments made in all other currencies are converted to the Ticket Currency on the date of payment, and all refunds will be issued in the same amount of the Ticket Currency that eXp received. If payment for Event Tickets is made in a currency that is different from the Ticket Currency, the payment amount shall be converted from the receiving currency to the Ticket Currency using the exchange rate published by Federal Reserve Bank at 12:00 p.m. PST, on the business day immediately preceding the payment date. However, all international payments and refunds made in currencies other than the Ticket Currency are subject to fluctuation in currency exchange rates, and eXp is not responsible for any differences in amounts resulting from fluctuation in currency exchange rates.
- Refund Deadline, Force Majeure. After the Refund Deadline, payments made are not refundable for any reason, including, but not limited to, failure to use Event attendance credentials due to illness or due to any event beyond the reasonable control of the parties, such as an act of God, national or global epidemic, natural disaster, travel-related problems or an act of terrorism.
- Use of Personal Registration Information. By registering for the Event, you grant eXp the right to use your personal registration information, including your name, phone number, and e-mail address, which eXp may, in its sole discretion, use to provide you direct communications from eXp about the Event, including communications about event sponsors, vendors, speakers, or other Event details. By registering for the Event, you authorize eXp (either directly, or indirectly through an API connection with a third-party registration platform) to share your name, registration status, and personal registration information, (a) with the Revenue Share Group to which you belong, as well as with your state broker team, for the purpose of receiving additional Event details; and (b) with those managing eXp’s ICON Agent Award program, for the purpose of determining whether you are eligible to receive agent credit (if applicable), for attending the Event. eXp operates in the United States and will transfer your personal registration information to the United States for the purposes outlined in these Terms. By registering for the Event, you consent to your personal registration data being transferred to or within the United States. All transfers to the United States are completed in compliance with the EU-US Data Privacy Framework, UK extension, and the Swiss-US Data Privacy Framework as more fully described in our third-party registration platform’s privacy policy which can be found at https://www.cvent.com/en/cvent-global-privacy-policy#certifications. Please note that your personal registration information, including responses to the optional demographic questions, is not shared with any Event Vendors for marketing or advertising purposes, unless you expressly request such information to be shared with a specific Event Vendor and permit them to scan your badge and receive your personal registration information. For clarity, age and gender identity information is only used internally by eXp personnel with a need to access such information to perform their business duties and will not be shared with any Event Vendor upon scanning your badge. Event Vendors that you authorize to scan your badge shall only receive your name, phone number, and email address. eXp deploys technical, organizational, and systematic controls designed to prevent unauthorized access, destruction, alteration, or misuse of your personal registration information. Personal registration information entered into third-party systems may be subject to the privacy policy of the third-party system.
- Text Messaging. By registering for the Event, you are consenting to enrollment in eXp’s recurring text messaging program which may use an automated system to deliver text messages, WhatsApp messages, or other similar electronic messages to the phone number you provided for the purpose of providing communications about event sponsors, vendors, speakers, or other Event details. Message frequency may vary depending on your registration type. eXp does not charge for this service, however, message and data rates may apply from your mobile carrier. If you have any questions or need help, please reply HELP in the message thread or contact eXp at [email protected]. You may opt-out of eXp’s messaging program at any time by sending STOP, QUIT, or other clear opt-out language in the messaging thread. You agree that after submitting an opt-out request, eXp is able to send one (1) confirmation message to confirm your opt-out intent and inform you of possible Event related information that will no longer be delivered via text message, WhatsApp, or other similar electronic messaging services. Upon confirmation or receiving no response, eXp shall remove you from the messaging service within ten (10) business days. If you wish to restart the receipt of messages, you must opt-in to the message thread again.
EVENT CONDUCT
-
- eXp Code of Conduct. All Attendees that are eXp real estate agents are expected to adhere to eXp’s Code of Conduct, as written in eXp’s Policies and Procedures applicable to each such eXp real estate agent.
- Nondiscrimination Policy. eXp is committed to providing a productive and inclusive environment for all Attendees at eXp-related events. eXp prohibits harassment, bullying, and unlawful discrimination (such as, for example only, discrimination based upon race, religion, national origin, age, sex, pregnancy status, familial status, disability, veteran status, genetic information, sexual orientation, or any other characteristic protected by applicable law). Any such behavior on your part will constitute grounds for immediate ejectment from the Event, without a refund for Event ticket purchases, and denial of your participation in future eXp events.
- Harassment and Bullying Policy. eXp is committed to maintaining a respectful and welcoming environment for all Attendees at eXp-related events. Harassment (including sexual harassment) and bullying in any form, whether physical, verbal, written, or visual, will not be tolerated. Any such behavior on your part will constitute grounds for immediate ejectment from the Event, without a refund for Event ticket purchases, and denial of your participation in future eXp events.
- Respecting Event, Event Venue, and Event Staff. Attendees are required to behave in a manner that is appropriate and in line with the expected level of dignity and respect suitable for the Event. Attendees are expected to respect the Event venue (including adhering to all posted rules and guidelines, and not damaging Event venue property). Attendees are further expected to show due courtesy and respect to Event staff, Vendors, and to other Attendees, erring on the side of displaying more courtesy and respect rather than not enough.
- Follow the Law. All Attendees are expected to follow applicable law. This means, for example only, and without limitation, that (a) distribution and use of illegal drugs are each prohibited at the Event; and (b) subject to applicable law, violence and threats of violence in any form are each prohibited.
- What To Do If You Witness or are Subjected to Unacceptable Behavior. You should report any behavior inconsistent with these principles to onsite Event staff. Event staff will be happy to help you contact venue security or local law enforcement, provide escorts, or otherwise assist those you for the duration of the Event. We value your attendance. You may also contact eXp directly to report a concern at [email protected].
- Ejectment. If eXp determines, in its sole and absolute discretion, that you have violated, or are in violation of, any of the terms or conditions within these Terms, then you may be immediately ejected from the Event, without a refund for Event ticket purchases, and you may be precluded from participation in future eXp events.
EVENT SAFETY
-
- Adult Conduct and Personal Responsibility. eXp will take reasonable precautions to provide a safe environment for the Event, but you are ultimately responsible for your own well-being. You are expected to conduct yourself as a responsible adult throughout the duration of the Event. This includes, but is not limited to, refraining from disruptive behavior, use of offensive language, and engaging in activities that may jeopardize your personal safety or the safety of other Attendees. It is your responsibility to exercise good judgment and avoid putting yourself into compromising situations. eXp shall not be held liable for any consequences resulting from your failure to act responsibly. If you are drinking alcohol at or in connection with the Event, you are encouraged to drink alcohol responsibly and to be aware of your own limits. eXp reserves the right to eject you from the Event if you appear intoxicated, without a refund for Event ticket purchases, and you may be precluded from participation in future eXp events. You must avoid situations that may lead to conflicts or disturbances. In the event of a dispute, you are expected to resolve the issue peacefully and promptly, seeking assistance from Event staff, if necessary. By participating in the Event, you affirm your commitment to maintaining a safe and respectful environment for all Attendees. Any violation of this provision may result your removal from the Event venue, without refund.
- Assumption of Risk. Participation in the Event involves inherent risks, including but not limited to, physical injury, illness, property loss, and property damage. Subject to applicable laws, you voluntarily assume all risks associated with attending the Event and irrevocably release eXp from any liability for such risks. If certain athletic or combative activities or sessions are offered at the Event, including, but not limited to, marathons, pickleball, or self-defense training, YOU ACKNOWLEDGE THAT THESE ACTIVITIES OR SESSIONS ARE INHERENTLY DANGEROUS AND PARTICIPATING IN THESE ACTIVITIES OR SESSIONS MAY INVOLVE THE RISK OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. YOU FURTHER ACKNOWLEDGE THAT ANY INJURIES THAT YOU SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF EXP, INSTRUCTORS OF THESE ACTIVITIES OR SESSIONS, AND/OR OTHER PARTICIPANTS. NOTWITHSTANDING THE RISK, YOU ACKNOWLEDGE THAT YOU ARE VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES OR SESSIONS WITH KNOWLEDGE OF THE DANGER INVOLVED AND YOU AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING THEREFROM, WHATEVER AND WHOMEVER THE CAUSE. Subject to applicable laws, and other legal restrictions, you hereby irrevocably and expressly waive, and forever release and discharge eXp Parties (defined below) from any liability for such risks and agree to unconditionally defend, indemnify, and hold harmless eXp Parties from and against any and all injury, disability, death, and/or property damage, as well as any Claims (defined below) arising out of or resulting from your participation in these activities or sessions. You will have the right to control the defense of any such Claims; provided, however, that you shall not enter into any settlement of any such Claim without the prior written consent of the applicable eXp Parties, unless the settlement is limited to the payment of monies by you (on behalf of the eXp Parties), and results in the full and final release of the eXp Parties from the Claim, without finding or admission of wrongdoing by, or injunctive or other equitable relief imposed on, the eXp Parties.
- Evacuation Routes. You understand the importance of being aware of and familiarizing yourself with evacuation routes in case of an emergency, and agree to do so in advance of any emergency.
- Health and Well-being. You are responsible for your own health and well-being. If you are feeling unwell, displaying COVID-19 symptoms, or have been in contact with someone diagnosed with COVID-19, you should refrain from attending the Event. In an effort to mitigate the risks associated with Covid-19, eXp will fully comply with all applicable Covid-19 rules and regulations, including but not limited to those promulgated by federal, state, province, territory, county, district, and city authorities, and those promulgated by the authorities managing the Event venue.
PERSONAL INFORMATION COLLECTION AND BADGE SCANNING BY VENDORS AT THE EVENT
Vendors may directly request your personal information at their exhibit booths, sessions, programs, or presentations (collectively, “Non-eXp Gathering(s)”). Providing your personal information to Vendors is optional, and you have the right to refuse to do so; you should review each applicable Vendor’s privacy policies to address your particular needs and concerns about how they will treat your personal information, including their practices for international data transfers. If, during the Event, you attend a Non-eXp Gathering, you understand and agree that when you present your badge for scanning or when you provide personal information to a Vendor, that personal information will go to a non-eXp entity and eXp takes no responsibility for, (1) how that entity uses your personal information, or (2) where in the world they may transfer your personal information.
PROMOTIONAL POLICY
-
- Competing Services. You may not promote any competing products, services, companies, or events at the Event (whether in any breakout session, general session, or Non-eXp Gathering), without written permission from eXp, through its Event organizers. If eXp determines that you are in violation of this policy, you may be immediately ejected from the Event without a refund for Event ticket purchases, at the sole discretion of eXp.
- Listings and Agent/Team Branding. If you are an eXp real estate agent, you may not distribute your individual and/or team-related marketing materials anywhere in or at the Event venue, without written permission from eXp, through its Event organizers. This prohibition pertains to both listing-related marketing materials, as well as agent brand or team brand related marketing materials. If eXp determines that you are in violation of this policy, you may be immediately ejected from the Event without a refund for Event ticket purchases, at the sole discretion of eXp.
- Claim of Being a Vendor. You may not distribute merchandise, distribute any marketing materials, or otherwise promote yourself as being an Event Vendor without first entering into a separate written agreement with eXp, through its Event organizers pertaining to the same. Merchandise distribution, marketing material distribution, and promotion of oneself as an Event Vendor shall each be subject to the terms and conditions set forth in any applicable separate written agreement. Violation of this rule may result in immediate ejectment from the Event without a refund for Event ticket purchases, and denial of your participation in future eXp events.
USE OF PHOTOGRAPHIC AND VIDEO MATERIAL TAKEN AT EVENT
To comply with global data privacy laws, eXp imposes certain restrictions on the use of multimedia at its events (e.g., photography, video, audio, online streaming, and all future mediums).
-
- Attendee’s Content. Unless otherwise prohibited by these Terms, you are permitted to use hand-held cameras and/or smart phones to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever. However, you are encouraged to capture your Event experiences and post your own social content from the Event (text, photos, audio, video, streaming), provided that doing so does not infringe upon the rights of any third party or eXp. Such infringement would include, but is not limited to, defamation or infringement of intellectual property rights. You shall be and remain solely responsible for securing whatever releases or permissions may be required by any third parties whose image(s), likeness(es), and/or voice may have been captured within your social content.
- eXp’s Content. eXp may hire professional service providers (photo/video/streaming/audio) to document and display the Event experience. eXp may also use social media (e.g., Twitter/X) to: (i) post real-time photos and videos to its social media feeds; and (ii) display select submissions from those feeds on monitors throughout the Event venue. By entering the Event, you are entering an area where photography, audio, and video recording may occur. Your entry and presence in and at the Event venue, (a) constitutes your consent to be photographed, filmed, and/or otherwise recorded, and to eXp’s release, editing, publication, exhibition, and/or reproduction (collectively, “Use”) of any and all recorded media of your appearance, voice, and name (collectively, “Likeness”) for any purpose whatsoever in perpetuity in connection with eXp, including, by way of example only, use on websites, in social media, news, and advertising; (b) constitutes your irrevocable waiver and release of any claims you may have against eXp related to the use of recorded media of you at the Event (whether such recording is performed by or on behalf of eXp for its business purposes, or by any Attendee and/or Vendor for their own purposes), including, without limitation, any right to inspect or approve the photo, video or audio recording of you, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement; and (c) constitutes your agreement that you are not entitled to any royalties or fees from eXp in connection with eXp’s Use of your Likeness for any purpose. You understand that all photography, filming and/or recording will be done in reliance on the foregoing. If you do not agree to the foregoing, please do not enter the Event venue.
- Restrictions on Photography, Recording or Steaming. Notwithstanding anything contrary to these Terms, eXp reserves the right, in its sole and absolute discretion, to prohibit photography, video/audio/digital recording, and/or streaming during certain sessions (e.g., general session) or within certain function spaces. eXp will communicate any such restrictions through signage, on-screen messages, announcements during such sessions, or by any other means deemed appropriate by eXp. You must comply with these restrictions when provided. Failure to do so may result in immediate ejection from the sessions or function spaces at the Event without a refund for Event ticket purchases, and denial of your participation in future eXp events.
LIABILITY WAIVER & RELEASE
You hereby represent and warrant that, (a) you are at or older than the age of majority in both your geographic area, as well as in the geographic area where the Event is being held; (b) you are of sound mind and competent to enter into legal binding agreements; (c) you have read, understood and voluntarily agree to be bound by these Terms; and (d) your agreement to these Terms is made of your own free will, without coercion or undue influence. As a material inducement to eXp for allowing you to participate in the Event, and without which you would not be allowed to participate in the Event, you, on behalf of yourself and your spouse, estate, executors, heirs, devisees, trusts, trustees, beneficiaries, employers, and any businesses that you own and/or manage (collectively, “Your Parties”), irrevocably and forever release, waive, discharge, exonerate, and hold harmless, eXp, and all of its or their respective members, managers, officers, directors, shareholders, employees, agents, successors, and assigns (collectively, the “eXp Parties”), jointly and severally, from any and all demands, claims, causes of action, monetary and non-monetary liabilities (including reasonable attorneys’ fees and costs), whether based on tort, contract, statute, common law, or any other type of legal or equitable theory which could be asserted in any court of competent jurisdiction, whether known or unknown (collectively, “Claims”), arising from or in any way relating to bodily injury, loss of life, property damage, property loss, and/or any other harm that you suffer (collectively, “Injuries”), whether occurring before, during, and/or after the Event, whether occurring at or away from the Event venue, except insofar as such Injuries were suffered solely as a result of eXp’s willful misconduct (as manifested exclusively through its employees, and none other) at the Event and while within the Event venue.
MEDIA PASS
-
- Application for Media Pass. Depending on the type of ticket, you may have an option to apply for a certain number of media passes during your registration for the Event (each, a “Media Pass”), which may be offered with or without an additional charge, for any individuals engaged by you to provide media services for the benefit of you at the Event (e.g., photographers, videographers, or social media representatives) (each, a “Media Pass Holder”). eXp reserves the right, in its sole and absolute discretion, to determine the number of Media Passes issued to each ticketholder, and to issue, withhold, refuse, or revoke Media Passes to anyone at any time and for any reason.
- Responsibility. If you have applied for any Media Pass during your Event registration and eXp has issued any of such Media Passes, you are responsible for ensuring each of your Media Pass Holder complies with these Terms, including, but not limited to, the restrictions on the use of multimedia at the Event, and securing permissions for using any third-party likeness(es). You and each of your Media Pass Holder agree to indemnify, defend, and hold harmless eXp Parties, jointly and severally, from and against any and all Claims arising out of or in any way relating to negligence, gross negligence, recklessness, willful misconduct, or any other act or omission of each of your Media Pass Holder, as well as any Claims arising out of or related to their presence at the Event.
- Conduct of Media Pass Holder. If you are a Media Pass Holder, the following terms will apply to you:
-
-
- You are considered an “Attendee” at the Event and are required to comply with all these Terms. You agree to follow eXp’s requests and instructions at all times during the Event, including, without limitation, prohibitions on taking photographs or videos, ejection from a session or function space, or removal of any equipment.
- You must obtain an Event badge for admission to the Event and wear your badge at all times during the Event. The Registered Ticketholder Substitution and Badge Policy set forth in these Terms will apply to you throughout the Event. Upon picking up your badge onsite, eXp may request you to attach identification tags to all of your equipment. If requested, you must keep these identification tags on all of your equipment at all times during the Event.
- Access to sessions (e.g., general session) or function space (e.g., VIP lounge) at the Event for Media Pass Holders is not guaranteed and will always be subject to eXp’s sole and absolute discretion. If eXp informs you that you are not permitted to enter a session or function space, you must leave immediately without objection.
- You must make every effort to act respectfully towards other Attendees, Vendors, and/or Event staff and to avoid any actions that may disrupt the Event, such as blocking hallways or obstructing views.
- You are required to use your equipment carefully to avoid causing harm, injury, or inconvenience to others. In the event that your equipment or its use causes any bodily injury, loss of life, property damage, property loss, and/or any other harm to any parties, including but not limited to other Attendees, Vendors, and/or Event staff, you will be solely responsible for any resulting damages, claims, or liabilities. You agree to indemnify, defend, and hold harmless eXp Parties, jointly and severally, from and against any and all Claims arising out of or in any way relating to your negligence, gross negligence, recklessness, willful misconduct, or any other act or omission of yours, as well as any Claims arising out of or related to your equipment and/or your presence at the Event.
- Violation of any Terms will constitute grounds for immediate ejection from the Event without a refund (if applicable), revocation of your Media Pass, and possible exclusion from future eXp events. eXp reserves the right, in its sole and absolute discretion, to request the removal of any of your equipment from the Event venue, to immediately eject you from any session, function space, or the Event, or to deny entry, ban, or remove you from further participation for any eXp events, with or without any cause.
-
ADDITIONAL TERMS AND CONDITIONS
-
- Amendments. eXp reserves the right to change, amend, add, or remove any of the above Terms in its sole discretion and without prior notice. You agree to be bound by such revisions, whatever they may be. These Terms, as may be revised, will be available for viewing at the following URL: www.exprealty.com/corporate-event-terms-and-conditions. It is your responsibility to stay apprised of the latest Terms, to which you will be bound. If one or more of the conditions outlined in these Terms should become invalid, the remaining conditions will continue to be valid and apply.
- Governing Law. These Terms will be construed in accordance with the laws of the jurisdiction where the Event is taking place (“Event Jurisdiction”) (without giving effect to that jurisdiction’s choice of law rules), and if the jurisdiction is a state or territory of the United States, then to the extent controlling, to the federal laws of the United States of America. The forum for any dispute or litigation arising out of these Terms shall be in the jurisdictional courts situated in the Event Jurisdiction. You hereby (i) consent to the personal jurisdiction in the Event Jurisdiction for the purpose of legal proceedings; (ii) waive to the extent not prohibited by applicable law, and agree not to assert, by way of motion, as a defense or otherwise, in any dispute or litigation arising out of these Terms, any claim that it is not subject personally to the jurisdiction of courts situated in the Event Jurisdiction, that any such dispute or litigation should be dismissed on grounds of forum non conveniens, should be transferred or removed to any court other than the one of the above-named courts, or that these Terms or the subject matter hereof may not be enforced in or by such court; (iii) agree not to commence any litigation other than before one of the above-provided courts; and (iv) agree that for any litigation or legal action between you and eXp arising out of these Terms, you shall bring such action only in the Event Jurisdiction and waive any claim and will not assert that venue should properly lie in any other location within the selected jurisdiction. Notwithstanding the previous sentence, you may commence any litigation or proceeding in a court other than the above-named courts solely for the purpose of enforcing an order or judgment issued by one of the above-named courts.
- Vendor Opinions. The ideas, views, policies, and opinions (collectively, “Views”) expressed by any Vendor (including those expressed at any Non-eXp Gatherings) are not necessarily the Views of eXp. The products and services displayed by Vendors at the Event should not be construed as being recommended or endorsed by eXp. Those Vendors having products and services that are recommended or endorsed by eXp are each an “eXp Trusted Provider,” and such Vendors may display the following logo evidencing their status as an eXp Trusted Provider:

In issues affecting legal, financial or accounting matters, you should consult trained professionals to address your individual situations.
